{"id":351,"date":"2008-11-07T16:22:07","date_gmt":"2008-11-07T16:22:07","guid":{"rendered":"http:\/\/www.ciberbullying.com\/cyberbullying\/?p=351"},"modified":"2015-07-22T12:50:25","modified_gmt":"2015-07-22T11:50:25","slug":"el-defensor-andaluz-ve-insuficientes-las-medidas-contra-el-ciberbullying","status":"publish","type":"post","link":"https:\/\/www.ciberbullying.com\/cyberbullying\/2008\/11\/07\/el-defensor-andaluz-ve-insuficientes-las-medidas-contra-el-ciberbullying\/","title":{"rendered":"El Defensor andaluz ve insuficientes las medidas contra el ciberbullying"},"content":{"rendered":"<p>En la presentaci\u00f3n del informe del menor 2007, Jos\u00e9 Chamizo, Defensor del Pueblo Andaluz y del Menor mostr\u00f3 la urgencia de actuar contra el aumento de casos de <a href=\"http:\/\/www.ciberacoso.net\/\" title=\"Acoso en Internet: informaci\u00f3n y consejos para evitarlo\">ciberacoso<\/a> o ciberbullying. <strong>\u00abHay que hacer algo m\u00e1s de lo que se hace\u00bb<\/strong>.<\/p>\n<p>Como medida preventiva, el Defensor reclam\u00f3 la creaci\u00f3n de un grupo de trabajo que elabore un <strong>estudio \u00abriguroso\u00bb<\/strong> ante los \u00abemergentes\u00bb casos de acoso a menores grabados y exhibidos en internet. La difusi\u00f3n de estas im\u00e1genes se convierte a veces para Chamizo \u00aben una vulneraci\u00f3n del derecho a la intimidad, al honor o en supuesto il\u00edcito\u00bb.<\/p>\n<p>Ya el pasado a\u00f1o, el Defensor abri\u00f3 tres quejas de oficio sobre el acoso o agresiones a menores grabados con tel\u00e9fonos m\u00f3viles que posteriormente fueron exhibidas en internet. En el presente a\u00f1o, el fen\u00f3meno \u00abcontin\u00faa\u00bb y la instituci\u00f3n ha tenido conocimiento durante estos meses de casos \u00abduros\u00bb de <strong><em>ciberbullying<\/em>.<\/strong> \u00abEs un problema que no ha terminado\u00bb, advirti\u00f3.<\/p>\n<p>Al margen de este estudio, Chamizo consider\u00f3 que deben ser los <strong>fiscales de menores<\/strong> los que se impliquen en el asunto, junto al grupo de Delitos Telem\u00e1ticos de la Guardia Civil, cuyo trabajo est\u00e1 dando resultados en temas de pedofilia. El Defensor asegur\u00f3 que se ha transmitido esta urgencia a los fiscales y que la respuesta es que necesitan un cambio en la legislaci\u00f3n nacional. \u00abMe parece que eso es esperar demasiado\u00bb, anot\u00f3 en declaraciones a los periodistas posteriores a su comparecencia.<\/p>\n<p>Chamizo defendi\u00f3 adem\u00e1s la necesidad de una reflexi\u00f3n global sobre la responsabilidad legal de los menores de 14 a\u00f1os, que si cometen hechos delictivos no pueden ir a centros de reforma en aplicaci\u00f3n de la Ley del Menor.
