La sentencia considera responsable al progenitor por no vigilar el uso de Internet que hac\u00eda su hijo (<em>culpa in vigilando<\/em>) y por no educarle adecuadamente en un uso responsable.<\/p>\n<p>Los hechos ocurrieron en octubre de 2008, cuando el menor public\u00f3 en su perfil de Tuenti una foto de una chica de 15 a\u00f1os en ropa interior junto al texto: <em>\u00abFefi la loca se te aparecer\u00e1 esta noche para hacerte una felaci\u00f3n. Para protegerte de su ataque env\u00eda esta foto a 10 de tus contactos, hazlo r\u00e1pido o Fefi se te adelantar\u00e1\u00bb<\/em>.<\/p>\n<p>Los dos menores residentes en Las Palmas, no se conoc\u00edan entre ellos. <a href=\"http:\/\/www.sexting.es\" title=\"Conoce los problemas de producir y publicar fotos er\u00f3ticas en Internet: el Sexting\">La fotograf\u00eda la hab\u00eda publicado la propia chica<\/a> en su zona privada, de acceso restringido, de la red social. Esto <a href=\"http:\/\/www.privacidad-online.net\" title=\"Conoce otros riesgos para la privacidad en la Red\">no evit\u00f3 su difusi\u00f3n<\/a> al resto de usuarios: de hecho, la propia menor se enter\u00f3 de su difusi\u00f3n a trav\u00e9s del perfil de un amigo.<\/p>\n<p>El hecho da\u00f1\u00f3 gravemente a la adolescente: seg\u00fan el informe psicol\u00f3gico realizado, la menor presentaba un s\u00edndrome depresivo al ser v\u00edctima de <em><a href=\"http:\/\/www.ciberbullying.net\" title=\"Descripci\u00f3n, noticias y consejos sobre el acoso escolar mediante nuevas tecnolog\u00edas\">ciberbullying<\/a><\/em>, que se mantuvo pese a cambiarse de colegio: no tardaron en reconocerla, la situaci\u00f3n se agrav\u00f3 y perdi\u00f3 todo el curso.<\/p>\n<p>El joven que <em>rob\u00f3<\/em> la imagen anim\u00f3 a sus conocidos en Tuenti a realizar comentarios vejatorios, que de hecho se realizaron. Una compa\u00f1era intent\u00f3 advertirle de <a href=\"http:\/\/www.netiquetate.com\" title=\"Aprende c\u00f3mo ser un buen ciudadano digital en las redes sociales en Netiqu\u00e9tate\">su comportamiento poco \u00e9tico<\/a>, de que estaba siendo ofensivo, a lo cual hizo caso omiso.<\/p>\n<p>Cuando la polic\u00eda se puso en contacto con el menor, \u00e9ste elimin\u00f3 r\u00e1pidamente la foto y pidi\u00f3 disculpas en la misma p\u00e1gina, aunque ello no ha evitado que el juez dictara una indemnizaci\u00f3n de 5.000 euros por el trauma causado a la joven al convertirla en objeto de burla.<\/p>\n<p>Fuente: <a href=\"http:\/\/www.elmundo.es\/elmundo\/2010\/11\/17\/espana\/1290016976.html\">El Mundo<\/a><\/p>\n<p>El siguiente v\u00eddeo de <a href=\"http:\/\/www.pantallasamigas.net\" title=\"Iniciativa por el uso seguro de Internet y una ciudadan\u00eda digital responsable\">PantallasAmigas<\/a> trata precisamente de c\u00f3mo prevenir los riesgos para nuestra privacidad en las redes sociales.
